This wildlife law seminar is aimed at Ecological Consultants and is taught by Penny Simpson who is an Environmental Lawyer for DLA Piper*.
Seminar content:
1. How to cope with the European Protected Species (EPS) licensing regime:
- What are the up to date EPS offences/provisions (taking into account changes to the law) and how should they be interpreted?
In terms of "Disturbance" offences; "Damage and destruction of breeding site resting place" offence; and other offences.
- What is Natural England's up to date policy/guidance?
- Where is there legal flexibility in the regime?
- How should you/your client manage your legal risks arising from the regime and how far can you go in giving legal advice?
- How to handle licence refusals?
2. Update on key Court judgments e.g. on Appropriate Assessment; interpretation of PPS 9; the duties of LPAs as regards EPSs and how to interpret "disturbance" of EPS.
3. Environmental Liability Directive - what are the significant business development opportunities for ecologists?
4. How to deal with wildlife crime committed by clients.
*Penny is an expert on natural environment legal issues. She was in house legal adviser for RSPB before moving to her present position where she now acts for a large number of public and private sector clients on EIA, planning, appropriate assessment, species protection, water and other environmental legal issues. She regularly trains ecologists on legal issues relevant to their work (she has trained 30 of the main ecological consultancies on EPS licensing during 2008 and 2009).
